The study reflects on how the criminal law interpretation of the category of “woman” affects the recognition of trans victims and the visibility of gender-based violence within the justice system.

We present this undergraduate thesis by Diana Sofía Jara León, focused on the criteria and evidentiary standards used in Chilean case law to apply the crime of attempted femicide. The study analyzes rulings from first-instance courts and the Supreme Court, reflecting on the presence — or absence — of a gender perspective in judicial reasoning and its effects on the legal classification of these cases.
